1. Agreement to Terms
These Terms & Conditions constitute a legally binding agreement between you ("Client", "User") and DA Digital LLC ("Company", "we", "us", "our"), governing your access to and use of the website getdadigital.com and all associated digital marketing, web development, SEO, and IT consulting services.
By engaging DA Digital LLC or placing an order through getdadigital.com, you explicitly accept and agree to comply with all terms herein.
2. Scope of Services & Deliverables
DA Digital LLC provides high-performance consulting and custom development services including:
- Web Architecture & Development: Custom frontend and backend engineering, WCAG accessibility integration, and responsive web design.
- Search Engine Optimization (SEO): Organic ranking strategies, technical audits, content structure optimization, and keyword analysis.
- IT & Cloud Infrastructure Consulting: Cloud deployment, security hardening, system architecture advisories, and API integrations.
All specific project deliverables, milestones, timelines, and costs are formalized in written Statements of Work (SOW) or service agreements prior to project commencement.
3. Payment Terms & Billing Authorization
Clients agree to pay all agreed-upon fees as set forth in their invoice or project schedule. Payments are processed securely via verified merchant payment gateways (including Verotel, NOWPayments, and CCBill).
Billing descriptors on credit card or bank statements will appear as getdadigital.com or DA Digital LLC. All fees are quoted and payable in US Dollars ($ USD) unless otherwise specified in writing.
4. Intellectual Property Rights
Upon full settlement of all outstanding invoices, DA Digital LLC assigns to the Client full ownership rights to final customized website code, graphic designs, and written content created specifically for the project.
DA Digital LLC retains ownership of pre-existing proprietary frameworks, software utilities, reusable code libraries, and core methodology utilized during project execution.
5. Limitation of Liability & Warranty Disclaimer
To the maximum extent permitted by applicable law, DA Digital LLC shall not be liable for any indirect, incidental, consequential, special, or punitive damages (including loss of profits, revenue, or business data) arising out of or related to your use of our services or website.
In no event shall the total aggregate liability of DA Digital LLC exceed the total amount actually paid by the Client to DA Digital LLC for the specific service giving rise to the claim during the preceding three (3) months.
6. Governing Law & Dispute Resolution
These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to conflict of law principles. Any dispute arising under these Terms shall be resolved primarily through friendly negotiation or binding arbitration.
